Introduction

These Terms of Service ("Terms") govern your use of our website and services. By accessing or using our services, you agree to be bound by these Terms.

Use of Services

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, secure, or error-free.

User Accounts

When you create an account with us, you must provide accurate and complete information. You are responsible for safeguarding your account and for all activities that occur under your account.

Intellectual Property

Our website and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

Eligibility

You must be at least 18 years old, or the age of majority where you live if that is higher, to use the service or to buy anything on it. We do not knowingly allow minors to hold accounts or make purchases, and we may close an account or refuse a request when we believe it belongs to a minor. This section is about who may hold an account and buy; the rules for the photos you upload are in Photos of real people below.

User Content

You retain all rights to any content you submit, post, or display on or through our services. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content.

Free credits. Free signup credits are limited to one account per person. We use network and device signals to detect duplicate accounts; a duplicate keeps its account but does not receive the free credits.

Photos of real people. You may upload a photo that shows a person only if you are that person, or you have their permission to use their image in an AI-generated video. You are responsible for having that permission. Do not upload photos of anyone under 18 without their parent or guardian's consent; photos of minors are accepted only on templates that keep everyone fully clothed and non-suggestive (such as the Hotel Lobby rap duo), and never for sexual or suggestive content of any kind. Do not upload photos of public figures and celebrities without their written consent.

Prohibited Activities & Acceptable Use Policy (AUP)

We enforce a strict Acceptable Use Policy to ensure safety, legal compliance, and ethical AI usage. You agree not to generate, upload, transmit, or distribute any content that falls into the following prohibited categories:

• Child Sexual Exploitation and Abuse (CSAE / CSAM): Zero-tolerance. Any attempt to create, upload, or generate depictions of sexualized minors, child exploitation, or abuse will result in immediate and permanent termination of your account, preservation of audit logs, and immediate reporting to the National Center for Missing & Exploited Children (NCMEC) and appropriate domestic and international law enforcement agencies.
• Non-Consensual Sexual Content & Deepfakes: Creating sexually explicit depictions, synthetic nudity ("nudification"), non-consensual intimate imagery (NCII), or unauthorized likenesses of real individuals without their explicit, verifiable legal consent.
• Sexually Explicit & Pornographic Material: Generating hardcore pornography, graphic sexual acts, or content intended primarily for sexual arousal.
• What is allowed: Lawful product advertising for underwear, lingerie, swimwear and sleepwear, including photos of adult models wearing them, is permitted as long as it contains no nudity and no sexual content. Whether a request falls within this exception is our decision, and that decision applies to that request.
• Extreme Violence & Graphic Gore: Depictions of real death footage, torture, mutilation, beheadings, suicide, self-harm instructions, or bodily harm.
• Hate Speech & Harassment: Content that promotes violence, incites hatred, dehumanizes, or harasses individuals or groups based on race, ethnicity, religion, sexual orientation, disability, or gender.
• Illegal Acts & Dangerous Materials: Actionable instructions or guides on manufacturing explosives, firearms, dangerous weapons, CBRN agents, illegal narcotics synthesis, or cyberattacks.
• Bypassing & Jailbreaking: Any deliberate attempts to bypass, subvert, trick, or "jailbreak" our automated safety filters, content moderation systems, or denylists.

Content Moderation

Depending on the feature, we may use automated tools, manual review, or both to check certain prompts, uploaded photos, generated media and account activity for certain categories of prohibited content. Not every prompt, upload or output is checked. Some of these tools are run by third-party providers acting on our behalf. Which checks apply, and when they run, can differ by feature and can change at any time without notice.

• No guarantee. Automated checks are imperfect: they can miss prohibited content and can flag lawful content by mistake. We do not promise that any particular prompt, upload or output will be checked, detected, blocked or removed.
• No duty to monitor. We are not obliged to monitor, review or pre-screen content before or after it is generated, and our use of moderation tools does not create that obligation.
• Our discretion. We may, at our sole discretion and without prior notice, refuse a request, withhold or remove generated media, restrict or suspend access, or end an account when we believe these Terms or the law have been breached, or to protect people, the service or our payment partners. To the extent the law allows, no refund is due for a violation (see Termination & Forfeiture).
• Records. We keep records of moderation events, including, where applicable, hashes of flagged prompts, for safety, compliance and dispute handling for as long as reasonably needed.
• Review. You can ask us to review a decision by emailing feedback@hittheroaddude-ai.com. A request does not guarantee a reply or a change to the decision.
• Authorities. We may preserve and disclose information to law enforcement, or where required by law, or to protect rights and safety. Where we become aware of apparent child sexual abuse material we will report it to the relevant authorities as required by law.

Reporting Content & Removal Requests

If content made with our service depicts you without your consent, including intimate imagery or an AI-generated likeness of you, email feedback@hittheroaddude-ai.com with "Removal request" in the subject, a link or description of the content, and how we can reach you. We act on valid requests within 48 hours, in line with the 48-hour requirement of the U.S. TAKE IT DOWN Act, make reasonable efforts to remove known identical copies of the same content, and suspend accounts that repeatedly violate this policy.

AI-Generated Content

Everything this service produces is generated by AI. When you publish it, you are responsible for labelling it as AI-generated wherever the law or the platform you publish on requires it (for example, Article 50 of the EU AI Act for deepfakes).

Generated music may not be used to impersonate any artist or be passed off as their work. Responsibility for how you use generated content, including copyright clearance, rests with you.

Payment Card Network Compliance & Indemnification

Our payment processing partners and international payment card networks (including Visa and Mastercard) enforce rigorous brand protection standards, including the Mastercard Business Risk Assessment and Mitigation (BRAM) and Visa Integrity Risk Program (VIRP/GBPP).

1. Compliance Acknowledgment: You acknowledge and agree that your use of the service must strictly comply with all payment network regulations prohibiting illegal, brand-damaging, or unauthorized adult content.
2. Indemnification for Network Fines: If your intentional, reckless, or negligent actions (including attempts to circumvent our content filters to generate prohibited or adult content) result in an investigation, audit, financial assessment, or fine imposed on us or our payment partners by Visa, Mastercard, or any card brand or payment acquirer, you agree to fully indemnify, defend, and hold harmless the platform, its founders, operators, payment processors, and affiliates from all resulting fines (including card brand penalties of up to $50,000+ per occurrence), legal expenses, damages, and operational losses.

Payments & Refunds

Credit packs are one-time payments, and their credits never expire. Plans renew each month or each year until you cancel them from the billing page. Within 10 days of a purchase, the unused part of it is refundable; free, promotional, gift, sign-in and check-in credits are not. A render that fails for a technical reason has the credits used for it restored. The full terms are in our Refund Policy.

Termination & Forfeiture

We reserve the right to suspend or terminate your account immediately, without prior notice, upon any breach of these Terms or our Acceptable Use Policy. In the event of termination for a violation of the Prohibited Activities or Content Moderation policies:

• All accumulated credits, active subscriptions, and account balances are permanently forfeited with no right to refund.
• Associated payment methods, email addresses, and network identifiers may be permanently blacklisted.

Limitation of Liability

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our services. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under a law that cannot be excluded, including the consumer guarantees under the Australian Consumer Law and statutory consumer rights in your country of residence.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by posting the updated Terms on this page.
